"Platform" refers to the Entreprise-Agadir.com website, its pages, modules, features, and associated services.

"Publisher" refers to the company operating the Platform, its managers, employees, and representatives.

"User" refers to any natural or legal person accessing the Platform, whether registered or not.

"Member" refers to any User who has created an account and accepted these Terms.

"Company Profile" refers to the account created by a legal entity or merchant.

"Freelancer Profile" refers to the account created by an independent professional or self-employed person.

These Terms are intended to:

• Define the conditions of access to and use of the Platform;
• Define the rights and obligations of the parties;
• Frame the rules of publication and moderation;
• Frame subscriptions and paid services;
• Define the applicable liability rules;
• Define the terms of personal data processing.

3.1 Open access

Some pages of the Platform are accessible without prior registration (directories, public listings).

3.2 Member-only access

Creating a profile and publishing listings require creating an account.

3.3 Access conditions

• Be of legal age (18 years or older);
• Have a valid email address;
• Carry out a real professional activity;
• Provide accurate and up-to-date information.

Two types of accounts are available: Company Account and Freelancer Account.

Each Member may only create one account per entity.

The User is solely responsible for keeping their login credentials confidential.

The Publisher reserves the right to validate, suspend, or reject any registration request.

It is strictly prohibited to:

• Publish false or misleading information;
• Create fake profiles or fake listings;
• Artificially manipulate scores or reviews;
• Use unauthorised bots or scrapers;
• Publish unlawful or defamatory content;
• Disrupt the technical operation of the Platform.

The Member is solely responsible for content published on the Platform.

Unlawful, misleading, or malicious content is strictly prohibited and may be removed without notice.

By publishing content, the Member grants the Publisher a non-exclusive licence to use it for the purpose of operating the Platform.

The Publisher reserves the right to moderate, suspend, or remove any non-compliant content.

Moderation actions may include: rejection, demotion, temporary suspension, or permanent removal.

Members may report any abusive content via the built-in reporting system.

The Platform offers paid subscriptions providing additional features.

Subscriptions are monthly and automatically renewed until explicitly cancelled.

Boosts are individual paid options that improve the visibility of a listing or profile.

• Premium Boost: featured on the homepage and at the top of the category;
• Top Category Boost: priority within the selected category only.

Boosts do not guarantee a definitive ranking position.

Listing rankings take into account several combined factors: subscription level, active boosts, keyword relevance, engagement rate, content freshness, and profile quality.

No specific position in search results is guaranteed.

The Platform applies a fair rotation system for sections with limited slots.

All elements of the Platform (trademark, logo, design, texts, source code) are protected by Moroccan and international intellectual property laws.

Any reproduction without prior written authorisation from the Publisher is strictly prohibited.

Personal data collected is processed in accordance with Moroccan Law No. 09-08.

Members have the right to access, correct, and delete their personal data, exercisable by email.

The Platform uses technical and analytical cookies to improve the user experience.

The Publisher does not guarantee the accuracy, completeness, or reliability of content published by Members.

Each Member remains solely responsible for the information published and the commercial relationships entered into.

The Publisher cannot be held liable for any direct or indirect damage resulting from the use of the Platform.

The Platform may contain links to third-party sites, provided for information purposes only.

The Publisher assumes no responsibility for the content, availability, or privacy policy of those sites.

The Member may close their account at any time from their personal account or by contacting support.

The Publisher may suspend or permanently terminate an account in the event of a proven violation of these Terms, without notice or compensation.

The Publisher reserves the right to amend these Terms at any time.

Members will be informed of substantial changes by email or notification on the Platform.

These Terms are governed by the applicable Moroccan law.

Any dispute relating to their interpretation or execution will be subject to the exclusive jurisdiction of the courts of Agadir (Morocco).

By using the Platform, you acknowledge that you have read, understood, and accepted the entirety of these Terms of Use.
